This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS (“Notice”) supplements the information contained in the main Privacy Policy of StarKist Co. (“StarKist,” “we,” “us,” or “our”), and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”). This Notice sets out how we used and protected any personal information you may have provided to us through your use of our StarKist.com and StarKistFoodService.com websites or any other StarKist website that includes a link to this Notice (collectively, the “Sites”), by social media, by phone, in writing or otherwise (collectively with the Sites, the “Services”) over the last twelve (12) months. For a description of our current data practices, please visit our main Privacy Policy. We adopt this Notice to comply with the California Consumer Privacy Act of 2018, as amended (“CCPA”), and other applicable California privacy laws.
This Notice explains how StarKist collected, used, shared, and stored your “personal information” (as defined under the CCPA) and certain other data when you used the Services over the past twelve (12) months, and how you may exercise certain rights you have under the CCPA in connection with your privacy and personal information. Personal information is generally defined under California law as information that, by itself or in combination with other information, identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked with a particular consumer or household (“Personal Information”). Any Personal Information that StarKist collects will be treated as set forth below and/or in StarKist’s main Privacy Policy.

Scope of this Notice
This Notice covers only the Services identified above and is only applicable to consumers who reside in California. This Notice does not apply to visitors, users and others who provide information to us through our Services but do not reside in California, and this Notice does not apply to information which you may send us by means other than through the Services. Other StarKist websites, locations and certain products or services, whether online or offline, may have their own specific privacy policies or notices which apply instead of this Notice, and you should consult those accordingly.
The Sites may contain links to external websites and other online locations, including those connecting you to any social media platform and/or third-party advertisements or sponsor information, that are not controlled by StarKist. StarKist is not responsible for the privacy practices and data collection policies for such third-party services. You should consult the privacy policies or notices of those third-party services for details about how they handle your personal information. Personal Information Collection and Disclosures
A requirement under the CCPA is to provide California residents with information on (i) the categories of Personal Information that we collect, use, disclose, and retain (“process“) in the preceding twelve (12) months, (ii) how we obtained such Personal Information, (iii) the purposes for processing your Personal Information, and (iv) the categories of third party recipients we share your Personal Information along with the purpose for such data sharing.

General Third Parties
The following third parties may receive any of the categories of Personal Information described above, depending on the circumstances:
- StarKist vendors who provide data storage, hosting and IT Support;
- Governmental authorities and law enforcement (in response to legal requirements);
- Auditors and legal advisors; and
- Third parties involved in a potential or actual merger, acquisition, consolidation, bankruptcy, or similar proceedings.

Data Retention Period
Over the past 12 months we have retained your Personal Information in accordance with the retention timeframes noted in our main Privacy Policy.
Selling and/or Sharing Your Personal Information
Over the past 12 months, we did not engage in any direct sale of your Personal Information as a way to generate monetary revenue.
However, as described in the “Third-Party Marketing Pixels, Cookies, And Other Tracking” section of our main Privacy Policy, we have used certain third-party online analytics and advertising providers which may have access to your IP address, online ID and online activity information. Such third-party access may cause you to receive targeted advertising based on your browsing behavior on our Sites and elsewhere online.
As a California resident, such access for targeted advertising purposes may be considered “Selling” or “Sharing” your Personal Information under the CCPA.
You have the right to opt-out of any such “Sale” or “Sharing” of Personal Information for targeted advertising purposes by using our interactive request form, which is available through the “Do Not Sell or Share My Personal Information” links on our Sites. Go here if you wish to opt out of the selling and/or sharing of your Personal Information.
Lastly, you have the option to configure your browser to send global privacy control signals to participating websites (which includes the StarKist Sites) for purposes of automatically opting out of targeted ad tracking. Please see the “Opt-Out of Certain Personal Information Use and Sharing Activities” section of the main Policy for further information.
Sensitive Personal Information Processing Activities
Over the past 12 months, we did not collect or use your sensitive Personal Information for purposes of inferring characteristics about you (as defined under the CCPA).
Profiling / Automated Decisionmaking Activities
Over the past 12 months, we did not conduct profiling activities or make automated decisions about you based on your Personal Information.
Notice of Financial Incentive
Over the past 12 months, we did not provide any financial incentives with respect to the collection of your Personal Information.
Your Rights and Choices
The CCPA provides California consumers with specific rights regarding their Personal Information. More specifically, you have the following rights regarding StarKist’s collection, use and sharing of your Personal Information:
- The right to request that we disclose what Personal Information we collect, use, disclose or sell about you;
- The right to request the deletion of Personal Information we have collected or maintain about you;
- The right to opt-out of the sale of your Personal Information or the sharing of your Personal Information for cross contextual behavioral advertising purposes (targeted advertising);
- The right to limit any processing of your sensitive Personal Information for purposes of inferring characteristics about you (StarKist does not engage in this activity);
- The right to opt-out of any profiling or automated decision-making activities that may be made with respect to your Personal Information (StarKist does not engage in these activities);
- The right to submit an appeal to StarKist if we deny your privacy request;
- The right to complain to a regulatory authority if we reject your appeal or you otherwise believe your privacy rights have been violated; and
- The right not to receive discriminatory treatment by StarKist, in terms of the services and prices offered on or through our Services, because you exercised the above rights.

Please note that in certain instances we may be able to reject your request if permitted under the CCPA. We will provide you with the reason if we reject your request. If the request relates to information that StarKist needs to make the Services function properly for you, you may no longer be able to use the Services.

We will honor any verifiable request to opt-out unless the sharing of your Personal Information is necessary to perform one of the following business purposes: to audit or count ad impressions and evaluate their effectiveness; to detect, protect against, and prosecute security incidents; to debug or troubleshoot functional errors that may arise with the Services; to complete short-term tasks related to an existing interaction you have with StarKist; to maintain or service your account; to process payments and fulfill orders or other transactions you authorize; to verify your customer information; and to ensure the safety and quality of the Services.
As mentioned in the Third-Party Marketing Pixels, Cookies, And Other Tracking” section of main Privacy Policy, the Sites may use cookies, pixel tags and related third-party tracking technologies and analytics services that are operated by social media and ecommerce platforms among other third parties, including Google, Meta (Facebook and Instagram), Pinterest, TikTok, X, YouTube, and Amazon. These third-party services may collect device-related data such as your IP address. Such tracking technologies are used to recognize your device when you return to the Sites, learn about what ads you see and interact with, and to serve you with ads about products or services in which you may be interested based on your browsing activity before and after you leave the Sites. Data collected through these practices also is analyzed to measure the effectiveness of ads for statistical and marketing research purposes. More directly identifiable Personal Information such as your name, email address and other contact information generally are not processed through these third-party technologies.
By using the Sites and StarKist’s other Services, you consent to the processing of Personal Information about you by these web analytics services in the manner and for the purposes described in our main Privacy Policy. All of the above-referenced cookies, IP addresses and marketing information will be collected and managed by our outside marketing vendors in order to provide you with targeted ads based on what you appear to be interested in as a result of your activity online, both on our Sites and elsewhere. If you opt-out, you will still see ads, but they will not be personalized based on your online activity. Please note that if you disable your cookies or upgrade your browser after opting out, you may need to opt-out again. Further, if you use multiple browsers or devices you may need to execute an opt-out for each browser or device.
